Rules that come with ownership

Three current federal rules that affect owners of these assets. Each comes with conditions and limits, and none is a reason on its own to own an asset.

100% bonus depreciation

First-year deduction for qualifying assets with recovery periods of 20 years or less, acquired and placed in service after January 19, 2025. Business-use tests, recapture on sale, and other conditions apply.

Section 179 expensing

Up to $2.5M a year, indexed ($2.56M in 2026), reduced when total qualifying purchases exceed about $4M. Limited to business income.

$15M estate and gift exemption

Per person, over a lifetime, indexed for inflation.

Limits apply too: how you take part in each activity decides how losses are treated, and a separate cap limits how much business loss can offset other income in a year.
